2. Definitions and Interpretation

a) The following terms shall have the following meanings for the purposes of this agreement:

‘Provider’ or 'The Company' means BE FEARSOME LIMITED, company number 10495946, registered at 124 City Road, London, EC1V 2NX.

'Client' means any person engaging in a paid or unpaid activity with the Provider.‘Agreement’ means these Terms and Conditions.

‘Services’ means the courses, content, and resources available through the Be Well Hub.

‘Currency’ means pounds sterling (£).

‘Payments’ means the amounts listed for courses or services on the Provider’s website or any promotional materials.

‘Courses’ or ‘Products’ mean self-guided wellness courses, including videos, written materials, and other educational resources, provided by the Provider.

‘Promotion’ means any limited-time offer subject to these Terms and Conditions.

‘Promotional Client’ means anyone redeeming an offer set out by the Provider.

b) Headings in this agreement are for reference purposes only and do not affect the meaning of the clauses.

c) References to singular terms shall include the plural and vice versa, and any references to specific genders include all genders.

3. Services

3.1 The Be Well Hub provides self-guided wellness courses designed for informational and educational purposes only. These courses are not a substitute for professional medical advice, diagnosis, or treatment.

3.2 The Provider offers general guidance and wellness education, which is not tailored to individual needs or circumstances.

3.3 All materials, resources, and access are provided solely for personal use by the Client.

4. Disclaimer

4.1 The content provided is for educational purposes only and should not be used as a substitute for professional advice. Always consult with a doctor, physiotherapist, or other qualified healthcare professional before starting a new exercise, diet, or wellness programme.

4.2 The Provider and its instructors accept no liability for any injury, loss, or damage incurred as a result of using the courses or relying on the information provided. All activities are undertaken at your own risk.

4.3 It is your responsibility to assess your fitness level and capabilities before engaging with any course content. If you experience pain, discomfort, or adverse symptoms, stop immediately and consult a medical professional.

4.4 While every effort is made to ensure the accuracy of the course content, the Provider cannot guarantee it is free from errors or omissions.

5. Intellectual Property

5.1 All materials, content, and information provided within the Be Well Hub, including but not limited to videos, written materials, graphics, and other resources, are the exclusive property of Be Fearsome Ltd and are protected by copyright law.

5.2 Clients are not permitted to copy, reproduce, share, distribute, modify, or sell any materials from the Be Well Hub without prior written consent from the Provider.

5.3 Access to the Be Well Hub and its resources is granted on a personal, non-transferable basis. Sharing login details or redistributing content is strictly prohibited.

6. Payments, Cancellations, and Refunds

6.1 Payments for courses must be made in full at the time of enrolment unless otherwise stated.

6.2 Cooling-Off Period: You have the right to cancel your purchase within 14 days of enrolment for any reason and receive a full refund, provided you have not accessed or started any course content. To cancel, you must notify the Provider in writing via email at [email protected]. Refunds, if applicable, will be processed within 14 days of confirmation of cancellation.

6.3 30-Day Guarantee: Selected courses are offered with a 30-day satisfaction guarantee. If you are unsatisfied for any reason within 30 days of enrolment, and the course has not met your expectations, you may request a full refund by emailing us at [email protected]. Refunds under this guarantee will be issued promptly and without question, provided the request is made within the specified timeframe.

6.4 Refund requests made outside the cooling-off period or the 30-day guarantee window will not be eligible for a refund.

7. Limitation of Liability

7.1 To the maximum extent permitted by law, Be Fearsome Ltd shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of the Be Well Hub or reliance on its content.

8. Changes to Terms

8.1 The Provider reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated via the Be Well Hub platform, and continued use of the platform constitutes acceptance of the updated Terms.

9. Governing Law

9.1 These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
